Alabama applies a 4% state sales tax, plus local add-ons that reach 7.5% in some places. That pushes combined rates as high as 11.5%. Alabama also has the highest average local sales tax rate in the US, at roughly 5.46%.

The bigger challenge is structure. Alabama is a home rule state. Many cities and counties write and administer their own sales tax rules instead of handing that job to the state. SaaS is taxable here because Alabama treats all software as tangible personal property. This guide walks through every step of Alabama sales tax compliance, from nexus monitoring through remittance.

## Alabama Sales Tax at a Glance

Alabama sales tax is a 4% state privilege tax on retail sales of tangible personal property, plus local taxes levied by more than 360 cities, counties, and districts.

Alabama is a home rule state. For sales tax, this means that Alabama Department of Revenue (ADOR) administers over 200 local sales taxes, but not all of them. Self-administered localities set their own rules and may require you to register with them directly.

Businesses still file and pay sales tax in one place, My Alabama Taxes (MAT), but you must also file and pay local taxes through ONE SPOT, which is inside MAT.

## Taxable Categories: What Alabama Sales Tax Applies To

Alabama taxes tangible personal property, software, and a short list of services. Most other services are exempt.

### Tangible Personal Property (TPP)

Physical goods sold at retail in Alabama are taxable at the combined state and local rate.

Common exemptions from sales tax include:

-   Prescription drugs
-   Gasoline and motor oil (kerosene and fuel oil stay taxable)
-   Items bought with SNAP benefits
-   Fertilizer, insecticides, seeds, and livestock feed used for agriculture
-   Sales to the federal government, the state of Alabama, and Alabama cities and counties
-   Sales for resale, when the buyer holds a valid Alabama license

Groceries are taxed at a reduced 2% state rate, with local tax on top. Prepared food is taxed at the full 4% state rate plus local. Cigarettes and beer are not exempt.

### SaaS and Digital Products

[SaaS](/blog/are-subscriptions-taxable) is taxable in Alabama. The state classifies all computer software as tangible personal property, no matter how it reaches the customer. There is no separate rule for downloaded software versus software accessed through a browser.

Two authorities drive this: [Admin Rule 810-6-1-.37](https://www.revenue.alabama.gov/wp-content/uploads/2021/12/810-6-1-.37-.pdf), which covers computer hardware and software, and the 2019 Alabama Supreme Court ruling _Ex parte Russell County Community Hospital, LLC_ where the court found software transactions taxable and did not carve out custom software.

ADOR confirmed after that decision that its long-standing position holds. Software transactions are taxable. Separately stated services that come with the software are not.

That distinction matters for how you bill:

-   Separately invoiced implementation, configuration, and software programming services are exempt.
-   Bundle those services into one line item with the software, and the entire amount can be taxed.

Sphere classifies Alabama software transactions automatically and applies the correct treatment to bundled and unbundled charges. Note that digital goods such as ebooks and downloaded music are also taxable.

### Special Rate Items and Exemptions

Alabama applies reduced state rates to several categories, and each still carries local tax on top.

-   Automotive sales: 2% state
-   Farm machinery: 1.5% state
-   Manufacturing machinery: 1.5% state
-   Rental tax: 4% general, 1.5% automotive, 2% linens and garments
-   Lodgings tax: 5% in the Alabama Mountain Lakes counties, 4% everywhere else

Most services are exempt. The main exceptions are utilities and telecommunications, which carry their own taxes. Mobile telecommunications service is taxed at 6% of gross receipts.

## Monitoring: When Alabama Sales Tax Applies to You

You’re required to collect Alabama sales tax once you have [sales tax nexus](/blog/nexus-tax-software) in the state. Alabama creates nexus two ways: economic activity and physical presence.

### Economic Nexus Threshold

Alabama's economic nexus threshold is $250,000 in retail sales delivered into Alabama during the previous calendar year. If you’ve sold this amount or more to Alabama buyers, you’re required to collect sales tax, even if you have no other ties to the state.

Alabama counts retail sales, both taxable and exempt, though wholesale sales for resale do not count when the buyer presents a valid Alabama license. Sales made through a marketplace facilitator that already collects Alabama tax also do not count toward your own threshold.

If you cross $250,000 in a calendar year, your collection obligation begins January 1 of the following year. That gap gives you time to register, but it can be easy to cross the line without realizing it. Sphere tracks your Alabama sales against the threshold and flags you before the obligation starts.

### Physical Nexus

Any physical presence in Alabama creates nexus immediately, regardless of revenue.

Physical nexus triggers include an office, store, or warehouse in the state, employees or contractors working in Alabama, inventory stored in Alabama including third-party fulfillment centers, and property owned or leased in the state.

Physical nexus also disqualifies you from the SSUT program (see below). For example, if you hold inventory in an Alabama fulfillment center, you collect full state and local rates instead of the flat SSUT rate.

### Simplified Sellers Use Tax (SSUT)

Alabama’s Simplified Sellers Use Tax (SSUT) program lets remote sellers collect a flat 8% on all Alabama sales instead of tracking hundreds of local rates.

How it works:

-   The 8% rate covers state and all local taxes.
-   You file one return. No address-level rate lookup and no separate local filings.
-   Eligibility requires no physical presence in Alabama.
-   Sellers below the $250,000 threshold can still apply to participate voluntarily.

Marketplace facilitators with more than $250,000 in Alabama sales have been required to collect and remit SSUT on facilitated sales since January 1, 2019.

## Registration: How to Register for Alabama Sales Tax

### How to Register

Go to [My Alabama Taxes (MAT)](https://myalabamataxes.alabama.gov/tap/_/) and select “Register a New Business.”

To register you’ll need:

-   Federal Employer Identification Number (FEIN)
-   Entity type
-   Ownership details and contact information
-   Estimated Alabama sales
-   Bank account information

Processing is not immediate and can take up to two weeks, so plan ahead.

Also, Alabama is one of the few states that requires sales tax license renewal. Renewal opens on November 1 each year and businesses must renew. There is no fee to register for an Alabama sales tax permit or to renew it annually.

### Local Registration

Regarding local registrations, you can file every local sales, use, rental, and lodgings tax through ONE SPOT in MAT, including taxes for jurisdictions the state does not administer. Filing is centralized.

Registration is not always centralized. ADOR advises contacting every county and municipality where you do business to confirm whether you need to register with them directly to collect their tax. Self-administered localities set their own registration requirements.

Alabama sales tax rates combine a 4% state rate with local rates that vary by delivery address.

Combined Alabama sales tax rates run from 4% to 11.5%, depending on the city, county, and special district.

Alabama has more than 360 local taxing jurisdictions and the highest average local rate in the country. Combined rates in Birmingham, Mobile, and Tuscaloosa land at or near 10%. Rural jurisdictions with no city tax can sit at the 4% state rate alone.

### SSUT Alternative

Remote sellers under SSUT charge a flat 8% on every Alabama sale.

That single rate covers state and local tax, which means no looking up the sales tax rate at a single address. For most remote sellers the simplicity is worth more than the rate difference, since many Alabama addresses carry combined rates above 8% anyway.

## Filing: How and When to File Alabama Sales Tax Returns

### Filing via MAT

Zero returns are required. File even in periods with no sales, because a missed zero return still triggers a failure to file penalty.

### Filing Deadlines

Alabama sales tax is due on the 20th of the month following the end of the filing period.

It’s important to note that if you pay by EFT, the payment information must be transmitted by 4:00 p.m. Central Time on or before the due date to count as timely.

### Timely Payment Discount

Alabama pays you to file on time. The discount is 5% of the first $100 of tax due, plus 2% of any tax above $100, capped at $400 per month.

MAT calculates it automatically. File or pay one day late and you lose the discount. Note that non-state administered local taxes filed through ONE SPOT may carry a different discount rate, and MAT is programmed for those differences.

### Late Filing Penalties

Late Alabama returns carry two separate penalties.

-   **Failure to timely file:** the greater of 10% of the tax due or $50.
-   **Failure to timely pay:** 10% of the delinquent tax.

Both penalties can apply to the same return. A $50 minimum on a zero return sounds small until you multiply it across missed periods in several jurisdictions.

## Remittance: How to Pay Alabama Sales Tax

You remit Alabama sales tax electronically through MAT at the same time you file.

### Remittance via MAT

MAT debits your US bank account by ACH once you submit the return.

-   EFT payment is required for payments of $750 or more.
-   Payment information must be transmitted by 4:00 p.m. Central Time on the due date or it’s considered late.
-   Local payments route to the correct jurisdiction, including self-administered localities

### Remittance for Foreign Businesses

Businesses without a US bank account cannot complete an ACH debit through MAT.
