Maine charges a flat 5.5% sales tax rate with no county, city, or special taxing district add-ons. Charge the same rate in Portland as you do in Bar Harbor.

While the flat tax rate is simple, Maine adds some complexity by taxing various categories of products differently. For example, prepared food is taxed at 8%, lodging at 9%, short-term auto rentals at 10% and adult-use cannabis at 14%. On January 1, 2026 the state also repealed its separate Service Provider Tax and started taxing streaming subscriptions like Netflix.

Standard software as a service is still not taxable in Maine. Downloaded prewritten software generally is. This Maine sales tax guide covers taxability, nexus, registration, rates, filing, and remittance.

## Maine Sales Tax at a Glance

Maine applies one statewide sales tax rate of 5.5% and allows no local sales and use taxes at all.

-   The general rate is 5.5% on tangible personal property, products transferred electronically (digital products), and enumerated taxable services. Category rates run higher, topping out at 14% on adult-use cannabis

## Taxable Categories: What Maine Sales Tax Applies To

Maine taxes tangible personal property, digital products, and a short list of named services. Most other services are exempt.

### Tangible Personal Property (TPP)

Physical goods sold at retail in Maine are taxable at 5.5%. But not all sales are taxable. Some common exemptions include:

-   Grocery staples. But candy, soft drinks, sandwiches, salads, chips, and certain bakery items are carved out and stay taxable
-   Prescription drugs for humans
-   Durable medical equipment, breast pumps, and mobility-enhancing equipment for home use. All three exemptions are new as of January 1, 2026
-   Prosthetic and orthotic devices, crutches, wheelchairs, diabetic supplies, and menstrual products

Sales to exempt organizations are also tax free, but Maine does not accept federal 501(c)(3) status on its own. The buyer needs an exemption certificate issued by Maine Revenue Services.

### SaaS and Digital Products

Standard [SaaS](https://www.getsphere.com/blog/are-subscriptions-taxable) is generally not taxable in Maine. When your customer accesses hosted software remotely and never receives a copy, there is no transfer of tangible personal property and no product transferred electronically.

The picture changes as soon as a tangible copy changes hands, or the content is media rather than software:

-   **Prewritten software is taxable.** Maine treats any non-custom computer software as tangible personal property, whether you ship it on a disc or deliver it by download. The distinction is that you receive a copy of the software rather than accessing it remotely.
-   **Custom software is exempt.** Maine defines a custom program as software written exclusively for one customer. A prewritten program modified for a specific buyer counts as custom only to the extent of the modification, and only if that charge is stated separately.
-   **Digital products with permanent rights are taxable.** A "product transferred electronically" is a digital product whose physical equivalent would be taxable. When you buy an ebook, a movie file, or an album outright the sale is taxable at 5.5%.
-   **Streaming became taxable on January 1, 2026.** Maine now taxes digital audiovisual and digital audio services at 5.5%. The statute covers electronic transfers granting “less than permanent use,” including subscriptions, so Netflix, Spotify, audiobook services, and podcast subscriptions all fall inside it.

### Category-Specific Rates

Maine adds four higher rates on top of the 5.5% general rate. The rate depends on the category of the item you sell.

-   **General sales tax rate:** 5.5%
-   **Prepared food:** 8%
-   **Liquor sold in establishments or for on-premises consumption:** 8%
-   **Rentals of living quarters (hotels, short-term rentals):** 9%
-   **Short-term auto rentals:** 10%
-   **Adult-use cannabis and cannabis products:** 14%

Prepared food is the common error point. Maine defines it as meals served on or off the premises, food and drinks the retailer prepares and sells ready to eat, and all food and drinks sold at a location where prepared food makes up more than 75% of gross receipts. That last rule catches a lot of cafes and delis off guard. If you cross the 75% line and even your packaged snacks (which would be grocery staples at another location) get taxed at 8%.

### Taxable Services

Maine taxes only the services named in 36 M.R.S. Section 1752(17-B). As of January 1, 2026, that list has ten items:

-   Rental of living quarters in a hotel, rooming house, tourist camp, or trailer camp
-   Transmission and distribution of electricity
-   Extended service contracts on an automobile or truck
-   Prepaid calling service
-   Cable and satellite television or radio services
-   Fabrication services
-   Telecommunications services
-   Installation, maintenance, or repair of telecommunications equipment
-   Ancillary services, such as directory assistance and voice mail
-   Digital audiovisual and digital audio services

Everything else is exempt. Haircuts, dry cleaning, landscaping, consulting, accounting, and legal work all sit outside the tax base. Internet access and data processing services are specifically excluded from the telecommunications definition, which keeps a lot of technology businesses from being pulled in sideways.

## Monitoring: When Maine Sales Tax Applies to You

Two things create a Maine collection obligation: physical presence, or $100,000 per year in gross sales to Maine buyers.

### Economic Nexus Threshold

Remote sellers must register once gross sales delivered into Maine exceed $100,000 in the previous or current calendar year. Maine dropped its 200-transaction threshold in 2022, so revenue is now the only trigger.

Note that even tax exempt sales count toward the threshold. Maine defines "Maine sales" as all sales of tangible personal property or taxable services delivered into the state, including exempt ones, so resale sales push you toward the threshold even though you collect nothing. Non-taxable services do not count, so revenue from consulting or professional work delivered into Maine stays out of the calculation.

Once you cross the threshold, you must register and start collecting sales tax by the first day of the first month that begins at least 30 days after you exceed the $100,000 threshold. Cross on May 15 and you must be collecting by July 1. You can also close the account later, if your gross Maine sales stay under $100,000 for two consecutive calendar years.

### Physical Nexus

Any physical presence in Maine creates [sales tax nexus](https://www.getsphere.com/blog/nexus-tax-software) regardless of revenue. An office, a remote employee, warehouse inventory, or a salesperson soliciting orders all qualify. So does leasing tangible personal property that sits in Maine, even if your business is based elsewhere.

There is no dollar threshold here. Just one employee working from a home office in Bangor means you register, collect, and file from your first taxable sale.

### Marketplace Facilitators

Marketplace facilitators like Walmart, Amazon and eBay are required to collect and remit Maine sales tax on every sale they facilitate into the state.

Note that marketplace facilitated sales do not count toward your own $100,000 economic nexus threshold in Maine, only your direct sales do. You still need to register and collect on direct Maine sales if those exceed $100,000 on their own.

## Registration: How to Register for Maine Sales Tax

### How to Register

Go to the [Maine Tax Portal](https://revenue.maine.gov/_/) and select "Register a New Business." Have your Federal Employer Identification Number (FEIN) ready, along with your NAICS code, business address, and the date you started making Maine sales. Every entity other than a sole proprietor needs an FEIN to register with Maine.

Processing is not instant. Your registration number typically arrives within one to two business days, and the paper retailer certificate follows by mail a few weeks later.

## Calculation: Maine Sales Tax Rates

Maine sales tax calculation comes down to one question: what category does the product fall into?

### State Rate and Category Rates

The general Maine sales tax rate is 5.5%. The higher rates are 8% on prepared food and on-premises liquor, 9% on lodging, 10% on short-term auto rentals, and 14% on adult-use cannabis.

On a multi-item sale, you can calculate tax per item or on the total. If you use the total, Maine requires you to subtotal each rate bucket separately. Maine also prohibits advertising that you will absorb the sales tax. If you do not state tax separately, your invoice must say the price includes Maine sales tax.

### What the Rate Applies To

The rate applies to taxable tangible personal property, prewritten software, digital products transferred with permanent rights, digital audiovisual and audio services, and the state’s enumerated taxable services.

Sourcing is destination based, so tax follows delivery into Maine. With one statewide rate, you never need to resolve a local jurisdiction.

Shipping is excluded from the taxable price only if you meet all three conditions: the product ships directly to the customer, it goes by common carrier, contract carrier, or US mail, and the shipping cost is stated separately from the price and from any handling fee. Miss one and the freight becomes taxable. Separately stated installation, application, or repair labor is also excluded, except for labor on telecommunications equipment.

## Filing: How and When to File Maine Sales Tax Returns

### Filing via Maine Tax Portal

Every registered retailer files through the [Maine Tax Portal](https://revenue.maine.gov/_/) using Form ST-7. Rule 104 mandates electronic filing, though you can request a hardship waiver and file on paper instead.

File even when you owe nothing. If every sale in a period was exempt, you still file a return reporting zero tax. Skipping it triggers penalties.

Maine Revenue Services runs an annual look-back review of every active account and adjusts filing frequency based on your actual liability.

### Filing Deadlines

Maine returns are due on the 15th day of the month following the reporting period. That is five days earlier than the 20th deadline used by most states, and it can catch finance teams off guard. If the 15th falls on a weekend or state holiday, the return moves to the next business day.

Monthly is the default, but you can request a less frequent schedule if your average liability is below $600 per month.

### Late Filing Penalties

Sales tax penalties in Maine include:

-   **Failure to file:** $25 or 10% of the tax due, whichever is greater.
-   **Failure to file after a formal demand:** the penalty rises to $25 or 25% of the tax due if you still have not filed within 60 days of the demand notice.
-   **Failure to pay:** 1% of the unpaid tax per month or part of a month, capped at 25%.
-   **Negligence or disregard of the law:** $25 or 25% of the deficiency, whichever is greater.
-   **Fraud:** $75 or 75% of the deficiency, whichever is greater.

Interest is tacked on top of penalties. The rate is set each January 1 and compounds monthly. For 2026 the annual rate is 9%.

Sales tax you collect is held in trust for the state. Officers, directors, and employees responsible for collecting or paying it can be held personally liable for unpaid amounts.

## Remittance: How to Pay Maine Sales Tax

You pay Maine sales tax through the Maine Tax Portal at the same time you file.

### Remittance via Maine Tax Portal

The portal prompts you to pay during the filing flow. Enter your US bank details and schedule the ACH debit before you submit the return, or print a voucher and mail a check instead.

Electronic payment becomes mandatory once your combined liability across all Maine taxes reaches $10,000 or more for the prior calendar year, and stays mandatory in future years. You can request a waiver and file on paper if you can show good cause.

### Remittance for Foreign Businesses

Maine's ACH debit process assumes a US bank account, which is a real obstacle if you sell into Maine from abroad. Opening a US account just to remit sales tax in one state is slow and expensive.
