## Oklahoma Sales Tax at a Glance

Oklahoma charges a 4.5% state sales tax rate on the gross receipts from sales of tangible personal property and certain listed services. Local governments stack their own rates on top of that. Physical goods are taxable in Oklahoma at the combined state and local rate. The OTC defines tangible personal property as anything that can be seen, weighed, measured, felt, or touched, including electricity, water, gas, steam, and prewritten computer software sold on physical media.

A few product categories work differently:

-   **Groceries:** The state portion of sales tax on food and food ingredients dropped to 0% on August 30, 2024, under HB 1955. Local sales and use taxes still apply to those same items, so groceries are not fully exempt.
-   **Prepared food:** Prepared foods, alcoholic beverages, and dietary supplements still carry the full 4.5% state rate plus local tax. If more than 75% of a seller's food sales are prepared food and utensils are available, everything that seller sells is treated as prepared food.
-   **Prescription drugs:** Prescription medications are exempt from Oklahoma sales tax. Over-the-counter medications and vitamins are not.
-   **Shipping:** Delivery charges that are separately stated on the invoice are not subject to sales tax. If you fold shipping into the item price, the whole amount is taxable.

Oklahoma also runs annual sales tax holidays. The state exempts clothing and footwear priced under $100 per item from the first Friday through Sunday in August. Accessories, athletic gear, protective footwear, and school supplies stay taxable. Retailers are required to participate.

### SaaS and Digital Products

SaaS is not taxable in Oklahoma. The state's sales tax levy covers tangible personal property and a specific list of enumerated services, and SaaS does not appear on that list. Because the customer never receives tangible property, it’s not considered taxable in the state.

This extends to most modern software:

-   Software delivered electronically is not taxable, whether prewritten or custom.
-   Digital products such as e-books, music, video, and ringtones are not taxable under Oklahoma Administrative Code 710:65-19-156.
-   Charges for internet access, website design, website hosting, domain registration, and electronic data processing are not taxable.

Prewritten software sold on physical media is treated as tangible personal property and is taxable. So is a mandatory software maintenance contract sold with taxable prewritten software.

You’re required to register and start collecting sales tax once you have sales tax nexus in Oklahoma.

### Economic Nexus Threshold

Remote (out-of-state) sellers who do a certain amount of business in the state are required to collect sales tax. For Oklahoma, this economic nexus sales threshold is $100,000 in taxable sales delivered into the state during the previous or current calendar year. Any seller without physical presence who crosses that number must register with the Oklahoma Tax Commission and collect state and local tax on sales sourced to an Oklahoma address.

Though other states vary, in Oklahoma only taxable sales count toward this threshold. Many SaaS-only companies never trigger economic nexus in Oklahoma, since their product isn’t taxable there.

### Physical Nexus

Any physical presence creates nexus in Oklahoma regardless of revenue. There is no small seller exception for physical presence.

Marketplace facilitators like Amazon, Walmart and eBay collect Oklahoma tax on behalf of their third-party sellers. A facilitator with at least $10,000 in Oklahoma sales over the preceding 12 months must elect either to collect and remit the tax or to comply with notice and reporting requirements.

When a facilitator collects on your behalf, those sales are excluded from your own economic nexus calculation. If the facilitator is not collecting, the sales count toward your own sales and you are responsible for the tax.

## Registration: How to Register for Oklahoma Sales Tax

### How to Register

Register for your Oklahoma sales tax permit through OkTAP by selecting “Register for a Business.”

You’ll need to answer whether you are a remote seller or have a physical presence in Oklahoma. This makes a difference because remote sellers receive a “vendor use tax permit” while in-state sellers receive a standard sales and use tax permit. However, collecting sales tax works the same way no matter which permit you receive.

It takes 5 to 10 business days to receive your permit via mail.

### Registration Fees

Oklahoma charges $20 plus a handling fee for a sales or use tax or vendors use tax permit, payable during the application. For in-state sellers, permits for additional locations cost $10 each.

In-state sellers are also required to renew your sales tax permit every 3 years. Vendor use tax permits, for remote sellers, do not expire.

### State and Local Rate

The total tax rate applies to the gross receipts from taxable tangible personal property and enumerated services delivered to an Oklahoma address.

Resale, manufacturing, agriculture, and qualifying nonprofit purchases are all exempt with proper documentation, and you need to keep those exemption certificates on file to support the exempt treatment in an audit.

Local taxes apply to the same items as the state tax, with two exceptions: residential utilities and unprepared (grocery) food and food ingredients.

## Filing: How and When to File Oklahoma Sales Tax Returns

### Filing via OkTAP

File your Oklahoma sales tax returns through OkTAP. Note that you must file a “zero return” by your due date even if you didn’t collect any sales tax that period.

### Filing Deadlines

Sales and use tax returns are due no later than the 20th of the month following the reporting period. For example, a monthly filer's June return is due on July 20.

If the 20th lands on a Saturday, Sunday, or observed state holiday, the return is due the next business day.

### Filing Frequency Thresholds

The OTC assigns your business a filing frequency based on how much tax you remit.

Oklahoma publishes that vendors with $50 or less per month in sales tax liability can be assigned to file semi-annually on January and June 20th. Most other filers will file monthly, except businesses whose returns average $2,500 or more per month, who are required to file monthly _and_ participate in the OTC’s electronic data interchange program.

### Late Filing Penalties

The penalty for late sales tax payment is 10% of the tax due once the tax has been delinquent for 15 days. Interest is at 1.25% per month from the due date until you pay.

Failing to file after a written demand from the OTC carries a penalty of 25% of the tax due. Repeated failures can lead to permit revocation and, for willful evasion, criminal charges.

You can request a waiver of penalty or interest through OkTAP once the tax is paid, with an explanation of what prevented timely filing.

## Remittance: How to Pay Oklahoma Sales Tax

### Remittance via OkTAP
