### Tangible Personal Property (TPP)

Tangible personal property is taxed at the combined rate in Pennsylvania. This covers most tangible goods sold at retail, from furniture to electronics to office supplies.

Pennsylvania exempts several categories from tax, including:

-   Groceries (food that isn’t ready to eat)
-   Most everyday clothing and footwear
-   Prescription and over-the-counter drugs
-   Residential heating fuels, including oil, gas, electricity, coal and firewood
-   Textbooks for use in schools

Pennsylvania is one of the few states that doesn’t tax clothing. They do make some exceptions, such as still requiring tax on sporting gear and formalwear. 

### SaaS and Digital Products

Digital products are taxable in Pennsylvania. Act 84 of 2016 expanded the definition of tangible personal property to include products that are electronically or digitally delivered, streamed, or accessed. It doesn't matter if the customer buys once or by subscription.

Taxable digital products include:

-   Video and music downloads and streaming subscriptions
-   E-books
-   Apps and games
-   Canned (prewritten) software
-   Photos and other digital media

Pennsylvania taxes only specified services. If a service isn't on the state's list, it's exempt.

### Economic Nexus Threshold

Pennsylvania’s economic nexus threshold is $100,000 in gross sales in the previous calendar year. Even if you are a remote seller not based in Pennsylvania but you cross that threshold, you’re still required to register for and begin collecting sales tax from Pennsylvania customers.

It’s important to note that all gross sales count toward this threshold, even if the sales are tax exempt. Once you cross the threshold, you’re required to begin collecting by April 1st, which is the 2nd quarter of the calendar year after the threshold is crossed.

## Registration: How to Register for Pennsylvania Sales Tax

### How to Register

Register to collect Pennsylvania sales tax through [MyPATH](https://mypath.pa.gov/_/).

To register:

-   Select “Register a New Business”
-   Complete "Pennsylvania Enterprise Registration Form (PA-100)”
-   Provide the following information:
    -   Business’s legal name
    -   EIN
    -   Business address
    -   Owner’s information
    -   NAICS code

Once you’ve registered, processing is usually immediate and you’ll generally receive your account number and sales tax license on the spot. The license covers sales, use, and hotel occupancy tax in one registration.

### Registration Fees

There is no fee to register for a Pennsylvania sales tax license.

### State and Local Rate

The sales tax math in Pennsylvania is simple. You charge 6% in 65 of the state's 67 counties. But charge 7% in Allegheny County and 8% in Philadelphia.

The rate is based on your customer’s location. For digital sales, this generally means your customer’s billing address.

### What the Rate Applies To

The combined rate applies to taxable tangible personal property, digital products (downloads, streaming, and canned software, including SaaS), and the state's specified taxable services. Most services and other exempt categories like clothing and groceries are excluded. Sourcing is destination-based, so the customer's location controls the rate you charge.

If a buyer is exempt, such as a reseller or a nonprofit, collect a completed Pennsylvania exemption certificate (Form REV-1220) instead of tax and keep it on file.

### Timely Filing Discount

Pennsylvania allows a small timely filing discount if you file and pay on-time. The discount is the lesser of:

-   $25 or 1% of tax collected for monthly filers
-   $75 or 1% of tax collected for quarterly filers
-   $150 or 1% of tax collected for semi-annual filers

Filing on time comes with a small reward.

## Filing: How and When to File Pennsylvania Sales Tax Returns

### Filing via myPATH

You file every Pennsylvania sales tax return electronically through myPATH using Form PA-3. Zero returns are required. If you're registered but collected nothing in a period, you still file a return showing zero sales tax collected.

### Filing Deadlines

Pennsylvania sales tax is due the 20th of the month following the end of the reporting period.

-   **Monthly returns:** Due the 20th of the following month
-   **Quarterly returns:** Due April 20, July 20, October 20, and January 20
-   **Semi-annual returns:** Due August 20 for January-June, and February 20 for July-December

If the deadline falls on a weekend or holiday, the due date moves to the next business day.

### Filing Frequency Thresholds

The Pennsylvania Department of Revenue assigns your filing frequency based on your tax liability for the third calendar quarter of the previous year. There are three tiers: monthly, quarterly, and semi-annual.

-   **Monthly:** Third-quarter liability of $600 or more
-   **Quarterly:** Third-quarter liability under $600
-   **Semi-annual:** Reserved for the lowest-volume filers

New registrants typically start on a quarterly schedule, and the DOR reassesses your filing frequency each year based on your actual liability.

High-volume filers face an extra requirement. If your tax liability for the third quarter of the previous year was $25,000 or more, you must make Accelerated Sales Tax (AST) prepayments by the 20th of each month, on top of your regular returns:

-   **AST Level 1 ($25,000 to $99,999 per quarter):** pay 50% of your liability for the same month last year, or at least 50% of your actual liability for the current month
-   **AST Level 2 ($100,000 or more per quarter):** pay 50% of your liability for the same month last year, with no alternate option

### Late Filing Penalties

The penalty for filing a Pennsylvania sales tax return late is 5% of the tax due per month, up to a maximum of 25%, with a $2 minimum. The penalty applies to any fraction of a month, so filing even one day into a new month adds another 5%.

Interest accrues separately on any unpaid tax until the balance is paid in full. The interest rate is set each year by the PA Department of Revenue based on the federal underpayment rate. For 2026, the rate is currently 7% annually, calculated daily.
