South Carolina charges a 6% statewide sales tax rate on retail sales of tangible personal property and a short list of taxable services. Local sales tax rates add up to 3% more, which puts combined rates between 6% and 9% depending on where your customer takes delivery.

SaaS is taxable in South Carolina, but not in the same way as many other states. The South Carolina Department of Revenue treats hosted software access as a communications service, so it gets taxed even though downloaded software usually does not.

## South Carolina Sales Tax at a Glance

The South Carolina sales tax rate is 6% at the state level, plus up to 3% in local sales tax rates. That makes for a combined range of 6% to 9%.

Local taxes are approved by voters county by county. Currently 43 of South Carolina's 46 counties impose at least one local tax, and most of those taxes are levied at 1%. The list includes the local option sales tax, the capital projects tax, the school district tax, the education capital improvement tax, the transportation tax, and the tourism development tax. Myrtle Beach is the only city in the state with its own city-wide local tax.

South Carolina uses destination-based sourcing. The rate you charge depends on where the customer takes delivery, not where your business sits.

## Taxable Categories: What South Carolina Sales Tax Applies To

Here’s what’s taxable in South Carolina.

### SaaS, Hosted Software, and Digital Products

[SaaS](/blog/are-subscriptions-taxable) is taxable in South Carolina because the state considers it a taxable communications service. Unlike in some other states, there is no business use exemption. [SaaS](/blog/saas-tax-software) is considered taxable no matter what your customer uses it for.

Downloaded software is treated differently. Under South Carolina law this is not considered tangible personal property and thus is not taxable. However, if any part of the software arrives on physical media, such as a disc or flash drive, the software becomes “tangible” and is therefore taxable. This makes South Carolina very different from most other states, so make sure you check your tax treatment of your products if you sell into the Palmetto State.

This also means that IaaS, PaaS, data processing and custom developed software aren’t specifically covered by South Carolina code. It’s recommended to contact a state and local tax (SaLT) expert or the South Carolina Department of Revenue before making a tax determination about these products.

### Tangible Personal Property (TPP)

Tangible personal property is taxable in South Carolina at the full combined state and local rate.

Some categories are exempt from sales tax or taxed differently:

-   Grocery/unprepared food is exempt from the 6% state rate. Local taxes may still apply, and whether they do depends on which local tax the county imposes.
-   Prescription medicine sold to an individual by prescription is exempt.
-   Textbooks used in a course of study at schools and colleges are exempt.
-   Sales to the federal government are exempt.
-   Maximum tax items, including vehicles, boats, aircraft, ATVs, and motorcycles, are taxed at 5% with the tax capped at $500 per transaction.

South Carolina also runs an annual sales tax holiday on the first Friday, Saturday, and Sunday in August. Clothing, computers, select fabric bed and bath items, and school supplies are exempt from sales tax during that weekend.

### Taxable Services

Only enumerated services are taxable in South Carolina. If a service is not on the list, it is not taxable.

The taxable list includes communications (which is where SaaS falls), furnishing of accommodations, laundry and related services, and electricity. Most professional services, including consulting, legal work, and accounting, are not taxable

Installation charges follow their own rules. If installation is separately stated on the invoice and the amount is reasonable based on your books, it is not considered taxable. If it is bundled into the sales price, it gets taxed along with the property.

## Monitoring: When South Carolina Sales Tax Applies to You

### Economic Nexus Threshold

South Carolina's economic nexus threshold is $100,000 in gross revenue from sales delivered into the state during the previous or current calendar year.

The measure is gross revenue, not taxable sales. It includes tangible personal property, products transferred electronically, and services delivered into South Carolina. Exempt sales count toward the threshold, too.

There is no separate transaction count. Volume alone does not create economic nexus in South Carolina.

Once you cross the economic nexus threshold, you must begin collecting on the first day of the second calendar month after nexus is established. That works out to roughly 30 days after the end of the month you crossed. For example, if you cross in March you’d start collecting May 1st.

### Physical Nexus

Any physical presence creates [sales tax nexus](/blog/nexus-tax-software) in South Carolina, no matter how large or small your business is.

It applies whether the presence is permanent or temporary, and whether or not you are qualified to do business in South Carolina.

### Marketplace Facilitators

Marketplace facilitators like Walmart or Amazon are required in South Carolina to collect sales tax on behalf of the 3rd party sellers using their platform.

If you sell via a large marketplace, the marketplace will likely collect sales tax on your behalf. However, if you sell via a marketplace and also directly through your own store, you're required to register for a South Carolina sales tax permit and collect sales tax on your non-marketplace sales.

## Registration: How to Register for South Carolina Sales Tax

### How to Register

You register for a South Carolina sales tax permit through [MyDORWAY](https://mydorway.dor.sc.gov/_/), South Carolina’s online tax portal. You’ll need your business identifying details, owner contact info, and FEIN to apply.

### Registration Fees

South Carolina charges a one-time $50 retail license fee for each retail location. Remote sellers (sellers with no location in the state) pay the same $50 to register.

### State and Local Rate

South Carolina’s state sales tax rate is 6%. Local taxes add on up to 3%, so combined rates can run from 6-9%.

Nearly all local taxes are imposed at 1%. The two transportation taxes in Charleston County are the exception, each levied at half a percent. Counties can stack multiple local taxes, which is how Charleston and Berkeley reach 9% while Greenville and Beaufort stay at the 6% state rate with no local tax at all.

### What the Rate Applies To

The combined rate applies to taxable retail sales delivered into South Carolina. That covers tangible personal property, SaaS and other communications services, prewritten software delivered on physical media, leases and rentals, and the other enumerated taxable services.

Keep in mind that unlike other states, downloaded software isn’t taxable. However, SaaS is considered a taxable communications service. Unprepared (grocery) food, prescription drugs, and other exempt categories are also excluded, though the local treatment of unprepared food varies by which tax the county imposes.

## Filing: How and When to File South Carolina Sales Tax Returns

### Filing via MyDORWAY

File your South Carolina sales and use tax return on MyDORWAY using Form ST-3. Paper filing is only available to taxpayers whose liability is under $15,000 per filing period. At $15,000 or above, electronic filing and payment are mandatory.

Zero returns are required. You must file a sales tax return by every due date, even if you made no sales, or if all your sales were exempt.

### Filing Deadlines

South Carolina sales tax returns are due on the 20th day of the month following the end of the reporting period. For example, a return covering the month of March is due April 20.

### Filing Frequency Thresholds

By default, South Carolina sales taxpayers are required to file and pay monthly.

Low volume taxpayers, however, can request to file monthly or annually, though the SCDOR must approve the request.

### Late Filing Penalties

South Carolina charges separate penalties for filing late and paying late.

The failure to file penalty is 5% of the tax due for each month or partial month the return is late, capped at 25%. The failure to pay penalty is 0.5% of the tax for each month or partial month, also capped at 25%.

## Remittance: How to Pay South Carolina Sales Tax

### Remittance via MyDORWAY

You’ll pay South Carolina sales tax through MyDORWAY at the time you file. Supply your US bank account details and the payment clears by ACH debit. Credit card and electronic funds withdrawal are also supported.
